I just got married last week

Hi everyone, I'm new to this forum but I have seen it helps!!! I just got married to a USC, and we are closing on a house next month (we will move together then). I have a few concerns... the first one is that she is 13 years older than me ( i'm 29 and she is 42), this probably will raise a flag. Is it good if she changes her last name to mine? and in what way shoul we be prepared for the interview? we got married in the court house and didnt do any party or took any pictures, we are waiting to have our new home to do so ( you are all invited!!!)
 
Well, my husband is 22 yeals older than myself and we got married in the City Hall, "no wedding day smiles, no walk down the aisle, no flowers, no wedding dress", cause we're very poor. My husband's relatives live on the East coast, I haven't met them yet. Well, what else? He hasn't met my relatives, and they actually were against that marriage and probably won't ever be okay with it. We have a crapload of joint papers though - bank accounts, phone bills, life insurance, old dental, new dental, car titles - you name it. We also have one pet budgie and will be getting another one soon :) However, here's your red flags and all that comes with it, but I'll tell you honestly - I don't care. Our marriage is legit, and if they deny our case, we'll still stay together. We'll probably go to my country or figure something interesting out :) The point is, I don't care as long as I'm with my husband :)

Anyways, back to your case - it all depends on the immigration officer. Some of them don't like age gaps, others are totally okay with it. And seems that most are okay. If your wife changes her last name to yours (or you change yours to hers) it'll be very good - it proves a long-term commitment. You will need some evidence of living together, like your mortgage (congrats on your new house!), bills, joint bank accounts, joint credit cards, insurance... And if you're throwing a party, take lots of pics :)

And what state are you in? What's your DO?

First of all, congratulations on your marriage. I hope you are still having the honey in the moon.... :p

On a related note, I don't see any problem in your case. If she is 13 years older than you, then let it be. USCIS responsibility and duty is to process immigration benefits to all who qualifies. I have yet to see a statute which governs age among people seeking immigration benefit, with the exception of aging out of the immigration benefit (turning 18 or 21). Also, USCIS doesn't regulate marriages of people in this country, and it they did, I would not have married my wife in this country, because I know USCIS is the most incompetent agency in the US govt. I mean, if they can't process a change of address, how do you expect them to produce a marriage certificate and license?

To prove the bona fine aspect of your marriage, having a joint title to your house will be powerful statement to USCIS, especially since you are closing on the house 2-3 weeks after your marriage. Health, Life, dental and car insurances, any pictures of you guys vacationing together in the last year or so, letters of people who know both of you attesting to your marriage. Utility bills, phone and cable bills, credit and bank joint accouts. All of these should be jointly held by both of you. So, send all the paperwork to USCIS, if you have not send them. When your interview comes, bring all these documents to prove the legitimacy and genuineness of your marriage, and you will be fine. Once again, enjoy your wife and don't be worry about what they think of the age difference. If they question you, ask them why they didn't have a problem with Woody Allen screwing his step-daughter, who was ages younger than him. Oh... Demi and Ashton....


If your wife was 66 and your were 29, then it could have been a different story, because what is a hunky 29 year guy doing with a 66 yr old woman? Unless you are after her social security check and antique earings.... :D

Lastly, congratulations on your new home. I wish you all the best at closing next week... take champagne to toast to your new home...
 
You people are dreaming if you think this will not raise a flag. Flags are raised when something is outside the statistical "norm". A 29 year old man marrying a 42 year old woman meets that criteria. A man marrying a woman 22 years younger does as well. I realize Ahston and Demi did it and that freak Woody Allen married his step-daughter. But for God's sake since when do we judge normalcy by what Hollywood does?

I'm not saying it's wrong. I'm not syaing it means the marriage is not real or you aren't in love. But you have to face the propsect that your case will be looked at more closely than if your arges were closer.

I tell you. your love and marriage is important than this shit immigration system. With true love no one can break your heart. So as long as it is a true marriage even if they dig up your case you can prove it. Any american knows there is no eyes or ear to true love. Congrats man enjoy your married life. My wife is older than me but we love. Who cares about age this moden age.Life is small make it sweet and age is not an issue. My supervisor lady (age 49) recently married a co worker who is a freshman (age 23). They are happy and blessed with a kid(she is preg).

I agree with Eddie, we're not saying that your wedding is fraudulent, we're just saying that your marriage will be looked at more closely so you have to really show proof that your marriage is bona fide.

I would suggest a lot of joint accounts, because of your age difference and the fact that you didn't have a reception nor even took pictures. You knew you were getting petitioned by your wife, why didn't you take a couple of pictures to help out your case, it would have been good proof, but anyway, just put together a bunch of other proofs.

I am also recently married, 2 months, and my husband is petitioning me and even though we have been together for several years and we are expecting our 2nd son in one month...even I still get worried because I've heard of some horror stories regarding immigration. We're not worried because of our situation (we are sure of ourselves) what we're worried about is getting a nutcase interviewer who will screw us over. So again, try to put together a lot of proof of your marriage so you don't have to worry.

And don't even mention Ashton, Demi and Woody Allen and his adopted daughter because those guys were not in need of immigration papers.
 
There are crazy and prejudiced interviewers out there... That's for sure.

I've known a man who married a girl 33 years younger than himself. He petitioned for a K-1, they got approved without an interview. I've also heard of couples who had no age difference at all and were grilled at their interviews for whatever reasons.

USCIS are not consistent in what they do, so it's always better to expect surprises.

And I LOVE the fact that I'm "out of the statistical norm" :) :) :)
 
I don't think you know what the word prejudiced means. And of course USCIS is not consistent :confused:and you should expect surprises, DUH!! If every single interview were exactly the same, asked the exact same questions, how effective do you think that would be in finding fraud? Immigration fraud via marriage is huge. I personally want the USCIS being as thorough as possible to prevent this fraud from occuring and everyone who is legitimately married should too.

First of all Congratulations on your marriage and sell of home. Yes you should change the name to the married name. It is a common although some spouses don't but you should given the situation. The age factor can go either way. I have the same situation. 15 years different although noone can tell by my looks ;) . It shouldn't be a problem if you have the major joint documents that demostrate marriage is a legitimate married and that the two of you live together as husband and wife (some situations are allow if you don't). For the interview, you need to have joint lease/mortage, joint bank accounts, joint credit cards, joint utilities, any pics of the two of you since you met, joint insurance, etc. and of course all documents requested by USCIS when filing and copies, your receipts from USCIS. Also, you said you are waiting to have proper ceremony when house is closed. When you do take pics and have ceremony, provide that also. It should be ok. Don't stress!! BE BLESSED :)

Hi guys, thank you all for your imput!!! it really helped me.
Immigration sucks!! but my wife and I like this country and here is where we want to live.
I will keep you posted with my case.

What is "normal" is highly subjective. Once upon a time, interracial marriages fell outside the confines of normalcy...who determines what is normal?

It may or may not raise a flag and that is dependent on the prejudices of the interviewing officer and not the law. Alas, most interviewing officers have their own prejudices...we all do.

To the originator of the thread, in a rational world ur case shouldn't raise any red flags...in reality it might...like I said it all depends on the interviewing Officer...ur case cannot be denied on age differential but it might fall under extra scrutiny which is why u need compelling evidence. Ur mortgage would be perfect...throw in Joint accounts and basically what Al suggested and u'll be fine. Just for good measure prepare to be asked questions related to the age difference.

U'll be alright...the worst that could happen is another interview...u can't be denied on age difference. Cheer up and good luck.

Personally I think women who manage to land younger men should be given a medal...but that's just me :D

On a less serious note..the term "normalcy" used to be "normality" till a US president(Warren G. Harding) goofed and used the former for the latter...it then became normal to say "normalcy" inlieu of "normality"...Ironic huh?
