I Have To Divorce My Husband

I would not say that she will have no trouble with USCIS if there is a previous marriage, an international divorce, an overstay and just 1 year of marriage when it comes to filing I360. Atleast the USCIS would be inclined to investigate some of it to see if this was immigration fraud. Again what I just said is speculation but I can't see how people can just come in and say that you have plenty of evidence and it's going to be a piece of cake.

They have thousands of these cases a day, do you really think they investigate everyone for fraud? they don't have the resources my friend. Also divorce doesn't equal fraud, it didn't work out! so what... about 50 percent of people get divorced each year, it's nothing new to USCIS. And yes if she has "plenty" of evidence it will work. I have seen many people post here with much less evidence then she has, they have all got approved! Where is your timeline??

That exactly was my point.....If outsiders like me suspects her case, then uscis could too...Remember 'Slam Dunk' comment? Trialderror is sounding like one....There is no slam dunk here buddy

The name is actually trialanderror. Well I don't know anythink about a "Slam Dunk" comment, I do know that you don't know me and I have been on this board much longer then you. Also "Outsiders" thoughts like yours doesn't influence USCIS decisions, not sure if you know that.......Immigration 101

Although I admit you don't have to be a genius to figure this case out, however, the advice I gave her came from someone who took the bar exam and is a immigration lawyer, not me but a close friend.

Looking at your timeline you are still going through the GC process, focus on your case first. When you have more knowledge then simply sending in the paperwork,( to the wrong place 3 times) as you suggested, then offer some insight. I suggest this before you hand down any more advice. You don't even have a GC yet.

My husband requests me to sign a kind of postnuptial agreement stating that he will provide me the docs requested at our last interview (need to be sent by 8/29/13) in exchange of me signin this "agreement".
First is it an agreement if it is in exchange of my immigration benefits?
Could I use it as another evidence of his abusives ways?
