i have many question about my case ?

hi every one

I applied for a political asylum in may 2008 and I have my interview in June 2008 and deny my application and he referred it to the judge I went to the judge in august 2008 and I asked for some time because I didn’t have a lawyer and my hearing date is august 2009 .

now I tried to apply for a work permit but I couldn’t because they said they stopped the clock so I cant apply until they grant my application , I have many questions I really need help and I found an orginazation who provide lawyers for free and they will be with me in court .


1 : in the hearing date in front of the judge , what type of questions or is it hard to get the acceptance I know its all about my case but I am talking in general and is it just one time hearing or it could be many times?

( I am from middle east and don’t practice my religion back home and this my reason in my asylum )


2: if they will grant my application what will happen , I know I can apply for a green card one year after but I saw people here waited 7 or 8 years to get the green card ? is it true ? and how long usually to get the green card after they grant my asylum ?

3: if the judge will deny my application and I want to appeal his decision , I want to know how long that’s going to take ? and is there any chance to win it ? am I allowed to work in us that time ?

honestly I have many questions as I said before please guys try to answer my question if have some time with details please .
 
Every case is different, unpredictable and we don’t even know the basis of your claim.

Since there is a denial, you are no longer eligible for work authorization unless the appeal is approved by the IJ, then you will become eligible again.

That’s great that you have a Pro Bono legally representing you (for free).

1- What kind of questions would be asked during your hearing before the judge? No one can predict, but we know such questions would mainly and most likely be related to your “asylum statement”. Usually a preliminary called ordinary hearing set for the date August 2009; and you will be given or mailed a notice in regards for the date for the master hearing (cross examination or questioning).

2- If you asylum is granted, a year from the grant you will be eligible to adjust your immigration status to permanent resident, unless you are inadmissible during the application for AOS, due to medical, national security, terrorism, criminality etc… the wait should not be longer that 12 months to get your LPR card, and could be as short as 6 months after filling of the application.

3- If the IJ denied your application, you have 30 days to appeal it to the BOIA; if the BOIA denies it you can appeal it to the Circuit Court of your geographical district; if the Circuit Court denies it you can appeal to Supreme Court (which is very selective – they do not take any case). No one can tell you how long the process would take, some judge are too busy some others are less, some are reasonable, some are too though… lots of conditions, parameters and factors and every case is different.

Any chance to win? No one knows, even your pro bono attorney. Unless you win your case at any of those stages you will not be given a working permit, because of the underlying of the denial, you will be better off to win your appeal.

I am not trying to discourage you but I want you to be aware that "The processes and procedures have to be structured around each individual case". It is very hard to lay down a blueprint of your asylum claim, due to the fact we have no information or knowledge of it.
In addition you have to convince the judge through mere answers that your case fully merits grant of the asylum.

i see it will take too long , honestly its not easy to servive if you dont have a work permit i am woundring how the asylum seekers servived before me ? did they worked under the table or what honestly i dont wanna do that i dont wanna risk it and you said its gonna take 6 month to get the pr after they grant my case , i saw pepole here in this forum waited 8 years untill they got thier green card?

The reason your clock is stopped is because you asked for time from the IJ. Your clock will not start until your case resumes which still has some time to go. You have no choice but to wait for your clock to resume.
 
honestly i am confused now , when i show up in the next hearing the clock will be resumed ? or i have to wait untill they grant my case to apply for a work permit ?
 
dont worry about GC yet, worry about ur asylum, u r refered to a judge because you failed to prove that you deserve asylum from immigration asylum officer.

study your case hard, find the lawyer soon and make him study your case.
unless you can prove that you you are refugee and very afarid of persecution if you go back home, your case will be denied and then very hard to win asylum, you will spend years in appeal process and also your chance s very low then.

thanks for your reply i am doing my best and i have my lawyer already and i just saw online the IG denial rate its jst 14 % means he granted 86% but i feel maybe because i always have a bad luck he will deny mine but however i am doing my best and i have a question for you guys what the diffrence between indivitual and master hearing ? and how long usually each on of them takes ? 1 or 2 or 3 hearings ? and what the averge of time between each hearing i heard 1 to 2 years between each one of them .
 
Master hearing and individual hearing

Hi Shadi2001,

With the master hearing, you inform the IJ that you would like to apply for asylum and you also plead to the charges set forth against you by the government. The master hearing, as you may already know, is the first hearing that you attend and is on your NTA. After pleading to the charges and making a request for asylum and witholding of removal and/or C.A.T, the IJ then informs you of the date and time of your individual hearing. Here (the individual hearing), you tell the judge why you should not be sent back to your COP. Your story needs to be consistent and believable to the judge.
The time frame between the master hearing and individual hearing varies from state to state...it depends on the IJ's calendar. I believe that it can be anywhere from a few months to a couple of years. If you don't want to wait too long for your individual hearing, I believe that you can ask your lawyer to request an expedited hearing from the IJ. With an expedited hearing, your case can be heard in a few months...perhaps 2 or 3.

If you are claiming asylum on the basis that you don't practice your religion in your country, then you may have difficult convincing anyone. It is very difficult case. You will need to produce concrete evidence that is the case. I have seen many cases where people claimed that they were born in Muslim, but were christians, and they have difficult convincing asylum officers. Being X religion and not being able to practice Y religion is not a basis for asylum. The judge will see your country conditions, and evaluate your situation. The only country in the middleeast where religion may be a basis for asylum is Iraq. For example, if you are coming from Egypt, and you are christian, the Judge would know that muslims and christians live in the peacefully even though there might be issues it would not mean that you will need pretection from the egytian gorn....in any case get ready a good case and defend your claim...
