I don't understand what is the logic behind the fact that some people are getting their GC with WAC 03 or even 04 and these of 02 are not getting them yet?

I am WAC02-173***** and I got only one finger print in 2002. I don't know what to do. I called my lawyer and she said that she can't do anything for me. Is it true that she can not do anything or is she lying?

I am very upset and don't know what to do, I have H1 until 2005 but I am very pissed off and I feel like I have to do something but don't know what.

Ever since the 1st FP in June 2002, the online message has been totally frozen for 24 mo. I was told by my lawyer that it's not my time yet according to JIT. When I asked why some people whose RD around mine already had 2nd FP done, the anwer I got was " could be the different EB". I don't think the lawyers know anything more than we do at this point.
 
Man I see what you are saying but really when I see people claiming that they got approved with an employment based WAC03/04, I got angry. By the way, your lawyer is simply a liar when he/she said that they come from different EB because as we know the fastest way to get a GC is to marry an american citizen but people on this board are claiming that they are getting GC with their wifes too so logically they are employement based like us.

Anyway, thanks for your reply and I will keep trying to push my lawyer to do something. I let you know if I have news.

I guess what they are doing is, they pick up a file from the pile, if it has everything, FP, RFE, they approve it right away; but if FP is expired, they throw it back to the pile, till JIT passed and you send million faxes. Then the the poor guy taking care of the fax inquiry may dig into the pile, find your file, issue you a FP notice. That explains why some people get approval filed later than those don't even have FP notice...Which is VERY WRONG!

Thats not the case, main thing is they are not trained and are not able to handle all these cases. so they do't know what to do now with this monster of backlog. So some monkey is comming up with ideas of pilot projects which puts the FIFO out of order. Same is FP you never got FP and i got FP notice twice in 4 months cause these guys themself do't know what they r doing. Its like buying a Lotto now ...Maybe ...Maybe ..Maybe.... :p
 
That might be the case

but then there is nothing they can do about it. If there is anything we can do to help the situation, is to find out the places where thing are not optimized, like management consults do, and hopefully that can help them improve a little

This is exactly what is bothering me and I think that the lawyers have to do something at this level. Why the assocoation of lawyers do not take the case to the INS or to the congress if necessary. Why we have to pay them then do the job in their places!

The INS is not a lottery and it should not be one.

I think that every one of us has to put some pressure on his/her lawyer to do something. Unfortunately, if we try ourselves to contact the INS, they will not take us seriously but when it comes from a group of lawyer, it will be different.

Just my opinion tho

I think AILA + lawyers are not bothered about ramdomness or fairness as long as the approval are coming out from CSC in regular basis. They are not going to earn any extra $$$ by questioning fairness for old applicants.
 
Even if this is the case, it is not JUST and we should do something about it.

If you think about it, the attitude of the lawyers is very suspicious. I will not go far if I say that they are happy with what is happening now with the old cases. They know that you will eventually need a EAD then AP for travelling etc... so potential money for them.

Since I can't pressure the INS, I will put pressure on my lawyer until she does something.
