I-EAD issue

We had applied through concurrent filing of I-140 & !-485 during August 2003.

We had a I-140 RFE on education evaluation which was answered by my attorney.

90 Days have passed by and wanted to take suggestions on getting an Interim EAD.

When we visited the Dover, Delaware INS office, they said that the I-140 needs to be approved in order to get the EAD

Can we go to Philadelphia Center to get the IEAD ?

Any suggestions ?

Mine is same case I applied concurrent I140/485/765/131 in October 2003. My I140 is still pending and I got Interim EAD from Local office in CT, I don't know why Delaware office can't issue ?
 
Can we apply for an I-EAD if an RFE is issued against the I-140 ?

My I-140 has an RFE and the lawyer says that he will send the reply by next week. My question is can I go the ARlington Office and apply for an I-EAD ? Will those people refuse me the IEAd if they see that RFE has been issued ?

I have the same scenario like radnus. But I applied my concurrent filing on September 2003. Got RFE on Education evaluation and submitted back on Jan 12. No EAD or anything else afterwards.

Radnus, can u tell me when did u get RFE and when u replied.

Concurrent Filings
Applications for Advance Parole and Employment Authorization (EAD) will not be adjudicated until the underlying Employment Based Visa Petition (I-140) is approved. However, if the EAD application is pending for more than 90 days and no Request for Evidence (RFE) has been issued on the underlying I-140 OR a response to an RFE has been filed more than 90 days, the individual may go to the local BCIS office to apply for an interim EAD card.
