I-EAD Denied

My I- EAD denied at philly(it is renewal case) They are asking for i-140 approval . My company dont provide that. it is company policy. I told they same to them but they said no and wait for VSC to approve case. I am feeling VSC may take 1 year to approve my case . my company will lay off my job. I got project which will go for 1.5 years.
These days it is too hard get the project of this kind.. dont know what to do.

I think we should all stand up to this gross injustice. First they delay our adjudication, and then torment us with these unnecessary formalities. I would say just keep working till your EAD comes in the mail. Anyway, EADs are renewed back-to-back, so effectively there's no uncovered period. If your employer asks for one, show them your Receipt Notice and tell them that you had applied a while ago and that as per the Notice they were to approve your EAD in a 60-90 day period which is now over and you still haven't received your EAD. Things are pretty much beyond your control since they're not providing even an iEAD. USCIS is taking everyone for granted. I would say, contact your local Congressman or Senator. These torture methods by USCIS should not be tolerated.
 
Why don't you tell your company that IEAD was not issued because you didn't provide them I-140 approval notice and ask your company for a copy?
 
I sent the copy of receipt to my new employer. My HR rep is very good. she said. I will put u in unpaid leave for few days until u get the actual card.But i cannot loose the project which will go for 1.5 yrs.

i have contact local senator on this case . how to proceed.??

please help me

I am not working for the same company . But i have a letter from my attorney stating that my i-140 is approved and they are filing my i-485.??

will this help me ??

It should, no harm in trying. Does your attorney have a copy of 140 approval? He might have it, when applied for 485.

This is new that they are asking for the actual 140 approval notice itself. Earlier even 140 approval itself was not required. Whatever.

In any case to clarify- EADs are NOT back dated for back-to-back approval dates they are only forward dated to avoid overlapping dates. So if your EAD or interim-EAD is not issued before your current EAD expires you are out of luck- you can not work.
The concept that EAD is pending does Not entitle you to work- I will not suggest anyone to do that.

Called the congressman. He said he will settled the matter with INS .. He also said that i am getting several complaints . Do ineed to realse my privacy information to them.?

EAD renewals are always renewed back-to-back provided you have applied for them well in advance, i.e., 90+ days.

Can you please let me know if they issue IEAD on same day.
Thanks for your Input, i never thought of I-140, i just got a faxed
copy of I-140 from my lawyer to take along with me.
iam worried if they won't issue i might loose my job too.

EADs are not issued back to back in situations they have to be back dated they are only forward dated.

Yeah.... Only if USCIS approve you before your current EAD expires. If its approved after your current EAD expiration, the new EAD will have the validation starting from approval date.

So, in between thse two dates you are unauthorized to work !!

This is verified by some forum users who got their EAD renewals after the first one is expired !!

They will issue on same day..

You need

1) filled form

2) copy of 485 and 765

3)i-194

4) money order for 120$

plus i-140 approval

good luck. Remeber you must there early at 11 they will close the doors .
 
Money order for IEAD, are sure. Because i saw couple of threads it said no charge and they will also take your picture.

Secondly i wanted to tell you, one of my very close friend was in a same boat, his EAD was expired before 90 days of renewal, he spoke to his company and they put him on Vacation, or Without payleave, he couldn't be on Payrole, i remember lawyer said
you have to be very careful, how you handle it.
Because if INS finds out your are in Big trouble, they will fine your Employer and may cancel your I-485.

Well, sb_tiger and sanga, you guys might be right, 'cos I don't know the latest whims of USCIS. I have renewed my EAD twice in the past and both the times it was approved before the previous one expired. Well, USCIS sucks big time and their incompetence should be reported to your local Senators. They need to overhaul the system, it stinks.
 
No , they dont take picutres. better carry with you. Otherwise you have run arround.. you have lot of time go to some photo shop near ur place and take pic.

Yes you have to pay 120$. thats what at counter guys told me. Come on INS is running out of money. That is why all these fees hike. they cannot impose these on taxes, if they did this, then the present goverment will be in trouble.
I dont know... Leave without pay is not problem either time. what if the person want to go on leave he has no PTO then .. he must go on unpaid leave.
 
Didn't you file G28 to change the lawyer when you changed the Employer ????

Why all this head ache ? Your new lawyer should take care of all this mess ..... or you are taking care of your case without a lawyer ....

Dear " canus_immi " and all

local BCIS office DOES not RENEW/REPLACE EAD - until it is pending at VSC for more then 90days........(some how only BOSTON office does it...)

That could be the reason for DENIAL...(and I'm sure.....) - file iEAD.....then go to local office........because EAD is common for family based GC...or for refuge...or.....so on.......no relation with 140.....as long as 485 pending... - they should not ask for I-140

Anyway.....you got to go back there again...........
