Family Backlog Retro

Terrible. Again DEAD ON ARRIVAL. I don,t no what to do. Desperate and demorlised with Visa Bulletin. Why don.t we write to Director OF USCIS. This is imply punishing by decreasing the VISA Bulletin every month. F2B N F1A was getting back . This is Ridiculous. We must, should ,could ,would write to DIRECTOR OF USCIS that Mr Aguire EXDIRECTOR had informed in the news(yr 2004) that all Backlog will be cleared before SEPT 2006. Is this is the way. TURTLE SPEED. LOOKS LIKE IT WOUN,T GO FOR 5 TO 6 YRS MORE.

 OH MY GOD !!!!!! i cant believe this.... weren't they saying they will expedite family visas??? whats up with that?? did they lie??? I dont understand.... how can they go back 2 years???? what about people who applied when their priority dates were current, but now they arent current any more?? what happens to them? I personaly dont know anyone but i am very curious as to how this works. what exactly are they trying to do by pushing back the dates???? Does this have anything to do with the illegals immigrating??? So illiegal immigration is harming legal people who abide by the law??? shouldnt we saysomething??? illegals' voices are heard, so they get what they want, what about us??? who will care about us if you dont stand up for ourselves?

NO worse way to wake up

I woke up and saw the new July bulletin... that is insane... my priority date F1A is Feb 2002... it was bad enough they were 10 months away at April 22 01, and only moved up by a week since september 2005.... but now 2 and a half years? I'm starting to wonder how much the fiscal year beginning in october will do to help retrogression. Either that or let's all cross fingers and hope they will pass this new bill that will add 200k more visas for the family preference. I believe Congress will start negotiating by end of the month on that issue.

I dont believe it.I applied for adj. based on visa number availability(jan 2001)and now the visa number is no longer available what will happen to the AOS applications that have been already filed.

new here

Hello,

I am new to this forum, and was wondering what does this family petition retrogression means? If someone could explain to me as if they were explaining to a two year old...

Also, I wanted to ask that if I got married to a USC, how long does it take nowadays to get a GC? I had spoken to an attorney few months back, who said in NJ it will take about 8 to 9 months and the GC would be good for two years initially. Can anyone tell me if that situation would still be true today?

Thanks,

I dont think there is anything to worry about. I believe what is happening is that they have take away our previledges to checkout visa availability with respect to per country quota. what we are seeing only one date and that is all chargebility areas date for india, china and philipines with few exceptions. just like our I-130s are in limbo so is now our visa numbers. its just wait an watch game now.

If you're planning to file for AOS based on USC's spouse sponsorship, you don't have to worried about the retrogression. That's only for those who are unmarried children of US citizens / unmarried children & spouses of Permanent residents.

If you're married for over 2 years, you'll be getting a 10-year GC instead of a 2-year.

I did have a TN and then got married to a green card holder for 2 years now going on 3 years, now my Tn is no more valid because I want it to wait that my husband get is USC and then apply for everything since I eard that being married with a green card holder will take forever to get my green card??? is true or not?? should I wait or should I apply now anyway??? I got my social security number but my visa is expired, don;t know what is the best to do??

Thanks Princess,

You will have to excuse my ignorance and tell me what does AOS means. My assumption is that it is the application with all the forms that you submit to become a GC holder after marrying a USC?

Thanks,

In you situation, you are probably better off waiting for your husband to get his USC'ship as you can apply for change of status right away when you apply for I-130 as a USC's spouse. You can also continue to stay on without a visa and all illegal presence will be forgiven when you apply for change of status as a spouse of USC. But you probably won't be able to travel outside the country until you get GC.
