I called BCIS today !!!

Hi,

I wanted to check my 485 status with BCIS so I called them today. I also had to change my address...The lady entered my info in her system and took details like phone no, email , other cases pending, date of birth, country of birth, citizenship and stuff... i was wondering why she is asking so much personal info...later at the end she said we will get back to u within 30 days....I asked her if i can talk to an immigration officer she says...its not reqd and she can take care of things... She also said only if your case is more than 20 mths old from the recpt date they will initiate a query..My 20 mths are getting over in sept..

What was this..does anyone has similar exp...???

Yeah....these questions are standard when we enquire about AOS.
They had asked me all these questions when I had made an enquiry a month ago.Nothing to worry about.

20 months seems right

I had spoken with a BCIS guy about a month ago for EAD renewal (which I got last week).

Speaking about the 485 delay, he clearly told me it would take about 20 months...i got the impression that was the stock standard response...

yes they also told me 20 months - so I phoned back this week as it was 20 mo from my rd - they took down all my info and said they will do an enquiry and I should hear something within a month or I need to call back
 
20 months - standard response

When I called BCIS couple of weeks back after
the 20 months after filing,I was told that they'd
generate an enquiry and I should expect to hear
from the service center in 4 weeks.

But I don't expect to hear anything better than
"your case is being processes blah blah and
it is currently taking us blah blah days" type of
response.

My on-line status has not changed since the
day one. "Your application was received on
Nov 15th 2001. It is currently taking us 180 days
to process this type of case". No mention of
finger prints being received or processing
resumed. I was first fingerprinted in Jan 2002 and
then again in Apr 2002.

I had made two enquiries one for my AP and one for AOS.
For AOS I haven't received a reply.
For AP I got a letter from the BCIS stating that the case has been assigned to the officer and within 30 days if I dont hear anything then I should call them back again.
Please note that I had applied for my AP 6 months ago.

I made the enquiry on July 8th for AOS....for which I have not got a reply as yet.
On July 23rd I made an enquiry for pending AP for which I got a letter on August 4th.

Do you have any idea why its taking so long to get your AP?

My husband and I have a problem here... We had applied for AP along with our AOS (RD 8th May). We are getting married (Indian wedding) first week of september and are still awaiting the AP. Since all the wedding preparations have been made we are getting a little tensed here.

I had called up the BCIS and they said they will do a status check and mail the details in 30 days. We were also planning to take the wedding cards to the local BCIS and ask them if they can issue us an AP. But my husbands lawyer is not happy with this so we quit the plan. Do you any of you have any suggestions?

Hello All,

I just called up BCIS now. They are indeed a bunch of Morons. My ND was 3rd Dec 2001- wac 02055xxxxx and I mentioned that 20 months was over. The person in BCIS checked my records and said that it now takes 21 months and I have to call after a month again if I am to make an inquiry. Complete waste of time. Got though after holding the line for fifteen minutes.

Time given = Current date - JIT date

Since the JIT says, currently processing Nov 2001, they are saying 20 months, since it is 20 months from Nov 2001 to July 2003. Now it is Aug 2003 - so it is taking 21 months. If the JIT doesn't change for the next 6 months, it will be 27 months.

Point being - they are counting the months that have elapsed from the JIT date and giving us the information.

Time given = Current date - JIT date

linda, do this.

Concentrate your energies on a scenario, where you are not guaranteed a GC, but you do have EAD/AP etc.

Once you firm up your position that well, then GC stress will automatically go away.

And then when you do get GC, you get an extra cookie. :)

All of us here are stressed about the delays and the uncertainity and the numerous laws that we have to understand before taking every step. There isn't much we can do - whatever we can for e.g. scream, cuss, swear, write petitions, call senators etc. and several of us here are doing so. However, the only thing that has kept me sane through the last 3+ years of being in this process, is the fact that someday I will get over it and move on, until then I too have to go through the pains. Almost all the cases here are pretty clean and straight forward, without any complications and I believe that it is only a matter of time when some nice case officer, who is having a bad hair day, will open our files, ask a few questions (RFE's) and will approve our case. Obviously, I am trivializing a very complex process, but it is just a way to see beyond this hurdle and the endless possibilities that exist.

Keep your chin up and be assured that something good will come out of this mess.

Sorry I have no idea why they are taking so long for my AP.
My guess is someone in BCIS is probably using my file as table mat and drinking coffee off of it.
The letter that I received from the BCIS states that my case has been assigned to an officer (big deal)......but no idea what the heck he is doing with it.
Since you are running short of time on your wedding, the only other thing that comes to my mind is to send a request for an emergency AP.I doubt if they would respond to it in two weeks but it might be worth giving a try.
Emergency AP is only given for urgent reasons like death in the family,high risk surgery in the family or oneself. But you can give it a try.
Send documents like invitation card, copy of airline tickets and whatever documents u have to show that your wedding has been planned .
I would also suggest to give a reason as to why the wedding cannot be postponed.

I am not sure if you can obtain the Emergency AP from a local INS office you may wanna ask your lawyer about that.
