i have been dating a woman for 1 yr.she is from the dominican republic.a year before we met she was pulled over for dwi here in new york.after countless postponements from her lawyer she had court on march 10,2010.she was chsentenced to 4 months in jail.so this past week (which was to be her release date june 30)she was picked up by i.c.e and brought to the immigration center on varek street in nyc.she has an ice hold.a few days later she was brought to monmounth county jail in nj(supposedly they house them from the varek street location).a few days ago i called the immigration center in nyc with her"a"(alien #)they told me that she was deported in 1992 and is now being charged with re-entry.and will most likely be deported.while speaking to the deportation officer over the phone,he told me that re entry is a federal crime.and she might be charged, either way she will be deported.i then said what will stop her from coming back here.he said her fingerprints will be taken before she can leave the d.r. to come to the u.s. and she wont be able to board the plane.so i spoke to the girls mother and she told me that the girl was born in the dr but moved here when she was 3 she is now 43.i guess what i am asking is that how was she able to get here in '92?fingerprints werent taken?also is there any chance that she will NOT get deported?i really care for her and i feel so helpless.can anyone give me some advice?thanks and god bless

i believe she entered illegally.she was deported in 1992 and came back yrs later.most of her life has been spent in the us

She really does not have any options now. If you have the money, hire an attorney who specialises in such cases, but it seems that she has painted herself in a corner with her actions. I may be wrong.

She has already been ordered deported, she has no right to see a IJ. There is a very good chance that she will have a future date in a Federal Court for re-entering the US without permission. She can get anywhere from time served to 5 years in jail depending on her record.

just an update.she was picked up at monmouth county jail today after spending 1 week there.i was told that she was going to metropolitan detention center in brooklyn because she is being prosecuted for re-entry.i called the place and they tell me she isnt there.so right now:I HAVE NO IDEA WHERE SHE IS AND DONT KNOW HOW TO FIND HER....I CANT TAKE LIVING LIKE THIS ANYMORE!!

Grow up! Chances are that she was taken from one jail to the local ICE office for processing, from there she will be taken to a local jail for housing. She will be given a free phone call.

After awhile, she will be taken to the Federal Court house and turned over to USM. She will not get bond from the courts, she will not get bond from ICE. It's funny, you act like you can not live without here, but the idea of living in the DR never crosses your mind.

It's Friday, get dressed and go out and find another one. Next time, find one that is legally here.
