I asked Questions about going back

I just came back from Germany and came back through Washington/Dulless airport. Since there was no line in the secondary room, I asked the officer about going back to home country. I didn't say I wanted to, I said whats the law about that just to educate myself. The officer was the nicest person I have ever met and very courteous.

In summary, his response was that if you are a permanent Resident and have a CARD, you can renew your passport. PR card is meant to be used with your national passport. RTD is for the people who cannot obtain a passport from their country. for instance, few years ago, Afghans couldn't get a passport because no country recognized the Taliban as a legit govt. RTD is meant for that according to the officer and also for ASylees/Refugees who have their pr still in process.

He also said that YOu can go back to your home country but be prepared to answer why you went and your reason. In his opinion, he hasn't seen anyone being denied entry because of going back to home country.

Hope this helps but I know every officer says different things.

That is exactly what some people misunderstand,there is no immigration law that prohibits former asylees to go to back to their home countries.yes it`s true u just can`t go back if the situation in your country has not changed whether you are either a GC holder or even a citizen.Yes you can renew your home passport after you have changed status like i did.

Yes u need to be prepaired to answer the purpose of your trip and that is the normal procedure.

Wishful thinking...

We all wish there was a clear cut rule about this issue but unfortunately there isn't any. All I know is that there are few people who fall through the cracks. The reason for that could be;
(1) Amibiguity of the rule governing regarding the green card revocation from asylees.
(2) Human element, meaning different people run into different people at POE when they enter. The staff at the POE has different level of know how about the immigration laws. This is especially true now due to their cross training and performing a wide range of duties.
(3) Attitude of different immigration officers towards immigrants/asylees.
(4) Reason every asylee had for going back that triggered him/her to go back to his/her country.

But my friends, at the end of the day, deep down in our hearts, we all know that after getting your I-551 stamp you can contact your Embassy to renew your passport and go to home country if you so choose to. But, I mean a big but, we all know that this can curtail to some serious consequences that we might not like. It all boils down to the fact that how serious is your need to go back to your country and how much you are willing to risk.
You might fall through the cracks and not run into any issue or you might have to say bye bye to your dreams of living in this great country. Its your call......

Well there are ways for people to visit home country if you have a GC and not even get in trouble. The easiest is to enter back into the u.s through canada. When you enter through canada, they only look at your GC and not your passport.

See the fact is simple, immigration laws are not fair in this country. Why can a H-1 bring his/her spouse within 3 months while a PR has to wait 4 years? What logic is there to that?? Many immigration laws are not simply fair to many residents here. I pay my taxes, I give in to the economy and I even work for the FEDERAL Government but when it comes to immigration, I have NO RIGHTS at all..Where is the fairness there?

This is a great country to live in, true you shouldn't jeaporadize your status here but if a man's dying realtive is in homeland whom he may never see again...is it fair to worry about "if they will let me in" or worry about if the realtive will survive?

As long as immigration is not fair, I dont see why anyone can also to be not fair with immigration...?
