I asked about this a lot

I asked rajiv khanna. Here is what I got:

-You can go to school (Full-time) while your 485 is pending.
-You can accept TA or RA if you have a work permit.

So, if going to school does not affect your 485, you can join the school now and when the approval comes, then that's it.

But, if you believe that you will not be approved if you go to school, for any reason like if your case is employment based, then I don't know what to tell you.

Thanks hassoon, your information are really helpful. My husband applied for 485 for me, so I don't think going to school will affect our 485. But I'm afraid that it will make trouble to our 485 if I want to keep my F-1 visa by issuing a new I-20 from a new school.

another quesiton, it's ok for a full-time student if his/her 485 is pending. How about part-time students? Like my school, if I want to keep full time student status, I have to take 12 credit point(4 courses) or one residence unit(five courses). I don't want to take so many classes in one semester. Then I can't keep full-time student status. Is it allowed?

thanks again

Erica

Part-time is good also

Because you have already applied for the 1485. You are adjustee now. You can go to school on part-time or full-time basis. My wife is doing part-time, no problem. But for me, since my case is employement based, It is not a good idea to go to school as this will make the chances to approve my green card much lesser, however, it is totally legal for me to go to school for full or part time because I am adjustee.

Hope this help

Hassoon, thank you for your reply.

Actually now I'm still holding student visa. I just want to continue my F-1 status in case our 485 are not approved. Since I can go back to school as an adjustee, I won't make any trouble to myself and INS.

Thanks for your help

Good luck!

Erica

I think you misintrepeted rajiv's comments. You cannot be on F1, but you can use EAD to continue your education when your I485 is pending.

You CANNOT be in F-1 status. When you filed for aOS, you became and Adjustee and your F-1 status terminated.

Hassoon,

But for me, since my case is employement based, It is not a good idea to go to school as this will make the chances to approve my green card much lesser, however, it is totally legal for me to go to school for full or part time because I am adjustee.

I have a question:
Why is the chance of approval lesser if an adjustee goes to a school while I-485 is pending?

Thank you for your time.

Is EAD required for attending school?

Does one need to have an EAD to attend school while his 485 is pending? I thought the EAD is required only for employment purposes. Can a person go to school without an EAD? Thanks.

Thank you for your time.

Because if your GC is employment based and you quit the employment to go back to school, it seems unlikely that you would then return to the same job that you were qualified for beore you started school.

It certainly raises questions.

Jim, thank you for your response.

I asked that question because I'm taking evening classes while I'm working full time. Is this situation still questionable?
