I am shaky about my qualification for EB-1A...please help...

hi everyone,

I'm new to this forum. Seems everyone here is experienced and helpful. I would like to ask you guys a favor to review my qualification for EB-1A.

I got Ph.D. in the US. My university was top 10. I satisfy 5 types of evidence of EB1. They are:

1. Evidence that the alien has judged the work of others, either individually or on a panel;<---this item might be weak since I only reviewed a paper once in a prestigious journal (number two in my field). But I have the invitation from the editor, and my review comment on hand.

2. Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field;<---this item can be strong since I got some good people to write a letter for me.

3. Evidence of the alien's authorship of scholarly articles in professional or major trade publications or other major media;<---this item can be strong. I have 6 papers in international journals. One of my papers has been cited for 75 times in 4 years.

4. Performance of a leading or critical role in distinguished organizations;<---this might be weak because the only evidence I can provide is the letter from my Ph.D. advisor and previous supervisor to prove my position was critical.

5. Evidence that the alien commands a high salary or other significantly high remuneration in relation to others in the field;<---this can be strong since my salary was 100% higher than the other in the same field.

I will have 15 people writing the testmonial letter for me. 7 are acquaintenance and 8 are non-acquaintenance. They distribute in US, China, and Switzerland.

The biggest problem I think will be I am currently unemployed. However, I already got a letter from a perspective employer.

Please help, and give me some comments...

My idea.
1. You are not qualified because of one 1 review.
2. It is hard to be based only on the letters. Your research should be a guide to your scientists.
3. It is not enough because on 6 papers. It is a small number for EB1A
4. It is hard.
5. Maybe

Total is only one you got.
 
Agree with the previous comments and evaluations.
Suggest to try EB2-NIW, especially that you are currently unemployed.
Or wait and establish yourself further in couple of years till your case gets strong.

I will apply for NIW since I don't have the backlogged problem in green card (Not either China or India born individual).
By the way, how should I present my unemployment in NIW? I think it's the most diffcult problem in my application.

Any suggestion?
 
NIW doesn't require you to be employed, but its certainly not helpful for your case. Put yourself in the adjudicator's shoes. You are supposedly extremly talented and of great value to this country ... but you can't find a job? You might want to find a job first, and then apply. Also, you have to prove that you have sufficient financial resources for the I-485 process, so unemployed that wouldn't work either.

I have been debating the issue that nscagony arose. My problem is the one for "a cat running after its tail". That means, I'm very important to national interest, and actually I have received two offers. However, I was unable to accept these offers due to my immigration status. One company said it's too complicating for them to sponsor me an H1B, and the other one issued a " conditional" offer. The second company has a contract with Airforce Research that limits hiring to PR or US citizen.

Well, the thing is that many research organizations need my expertise, but due to the security or sensitive subjects, they only hire people with PR or citizen. That is the reason I can not find a job immediately.

What would you guys think?
