Why blame NSC alone??
The whole immigration process is a screw up where even the laws as well as the practice are flawed.
I will soon be starting new threads on 'State-wise PDs Vs Perm PDs vis-A-vis Visa Bulletins' and on 'Visa Bulletins vis-A-vis RDs and PDs'.
The few lucky ones from India (don't know how many) who got their labor approved through PERM before September 2005, either filing for the first time or filing to port an older priority date into the EB2 category were able to file their I-485s in September 2005 or before, These guys are certain to get their approvals subject to namecheck clearance.
Others under EB2 India whose PD is prior to September 2005 and were screwed by the BECs and did not file through PERM and approved before September 2005, it will be a dreaded wait as it has been for the past 2-4 years.
Now, with the July 2007 VB fiasco, if they make it current again for all EBs in August or in the near future, we will again see approvals for those with PDs of 2007 before the PDs of 2005 are approved. So my take is, the USCIS should not have made all EB current in July 2007 in the first place. They do this on and off to break any kind of unity among the legal immigrants.
