Hi everyone i forgot to specify my husband is not in jail at this time, what i wrote probably my misinterepted as him being currently locked up. We already have a co-sponsor and we just wanted to know what we need t prove that we have a bona-fide marriage together we are living together and we have a 7 month old baby. I have the stamp in my passport from entry but not the I-94 card that is why i am asking if we could go ahead and file without it.
 
perhaps, you should continue writing in your previous post, as opposed to creating a new topic where nobody knows what you are talking about.

You must have I-94 or apply for its replacement.
 
it dont matter here you come from,you have to get a i-94 from clip in your passport,onless you are canadian. it you loss it,it will cost you to replace it.
you also mention that your husband was lock up.please see an lawyer before you file any paper with uscis.
