Friends,

My mother arrived USA on ..04/27/08
She got 10 year multiple entry.
Just now I saw ..her I-94 valid thru 09/26/08 only

How it possible? it is only for 5 months..I-94 generally valied for 6 months right? so, what is her correct expiry date of I-94?
Is it correct time to apply for her extension?
She definitely leave before end of NOV. is it still necessary for EXT apply?
thanx..

She should leave immediately to her home country as she is over staying in USA as her I94 date is 09/26/08. I do not think that you can now apply for extension.
Please wait for some seniors opinion.

it is usually no more than 6 months, but immigration officer has the liberty of reducing the duration of your stay. make sure she respect the date or apply for an extension.

I have seen I-94s issued for a stay of 24 hours only.
Since your mother got a restricted I-94, I would strongly advise not to apply for any extension.

Thanx everyone.
So, looks like go out of US without apply for extension is best option I guess.
She need to be here upto mid NOV.
Is there any pblm to go out with expired I-94? I know to get visa again is pblm. what else?
She don't need visitor visa any more, she gonna get GC within one or 2 years.
So, apply for I-94 extension now still hurts? please advise. Thanx..

It is likely that she received a shortened I-94 time if she had visited before and had not spent much time in her home country.Since she has overstayed her authorized visit, her visa will most likely be voided by the next US immigation officer she encounters.

You have already been told that she cannot extend since she is out of status. She can leave without any problem; tell her to be sure to return the I-94 because if it appears that she overstayed more than 180 days she will be banned for 3 years from entering.

Also, in case you wondered... her 10 year visa is now void/cancelled and she will have to re-apply for one (which will be hard to do since she overstayed).

Good job! great thinking...

It seems you have already made up your mind with regards to what course of action you will take. So why are you fishing for more advice?
