I-94 validity

Senior members please help !!!

My H-1 Visa is valid upto 04/DD/2006

When i enetered US last year ( Aug 2003), as my passport was expiring in May 2004. The officer at POE wrote under the admiitted seal in the passport as 'PP exp may 2004' after that he gave back my passport and forgot to issue me the I-94. Even i did not notice it. when i found out the I-94 was missing I went to local BCIS office and explained the situation they asked me to apply I-102 for lost I-94. I applied (I-102) for I-94 through my lawyer (got the reciept No) and the application is still pending.
I have already renewed my passport.

-- now will i be out of status if i won't get the I-94 by May 2004.
-- do i have to go out of US and come back or wait until i get the
I-94

I will go to Mexico or Canada and submit my I-94 to Mexico or Canada immigration(they will not ask for I-94 but you can give) and enter with new I-94 or wait for I-94
OR
if you dont want to wait r go to same POE where you last entred and meet the officer and get the I-94 and explain the situation if you have boearding pass or any record that you entred on XYZ date explain it to supervisor
