I-94 Rfe I-485

:confused: I got an rfe on my I-485, USCIS wants copies of a couple of my I-94 cards. The thing is that every time i changed status i return them to the customs office in the border. What do i do if a dont have copies of these I-94, i have the stamps on my passport but not the cards. Please help :confused:
 
It is typically advisable to keep copies your approval notices that have I-94 attached. Most often, lawyer and employer should have copies of them in their file. I recently asked my lawyer to send me a copy of my 9 year old student work permit. Check with lawyer if you can submit any other evidence. I am assuming your passport should also have customs stamps with date, I-94 no etc and sending copy of passport may suffice.

I am in a similar kind of situation. I do not have a copy of one of the I-94. I do not have the H4 approval notice too since my H4 stamping was done based on my husbands. My lawyer is hesitant to file my i-485 since I may receive a RFE requesting for the missing i-94. We have submitted the FOIA request to get that I-94. But we have already filed my husbands i-485.

Not sure whether we can file mine since the dates are current to me.
 
Dont worry

Dont worry., my wife was in a similar case and case was approved. We did not have copies of i-494, but sent copies of stampos passport. thats all you need
 
We just realised that I was out of status for more than one year from
April 2001 to August 2002. Here is what happened.

Entered US on H4 Jan 2001, Husbands H1 was valid till April 14th 2001,
So I94 was issued till April 14 2001.

Husband's company Applied for his H1 Extention and didnt apply for my
H4
( not sure about this, its an assumption as I dont have H4 for this
period, and I can't verify, the previous company and the attorney's
office doesn't exist anymore).

Husband got H1 approved. We were under the impression that If husband
is
in status, I am in status by default.

We send our passports to St Louis for Visa stamping in October 2001, we
got the visa stamped on December 14, 2001.

Husband changed employer in August 2002. The new employer applied for
Husbands H1 and my H4. The date on H4 approval is August 2002 to April
2003.

I travelled to India in October 2002, and came back in Jan 2003. I have
maintained status since. Also, I travelled to India and got my Visa
stamped in July
2003 ( Validity july 2003 to April 2004).

so, I was out of status from April 15 2001 to August 2nd 2002 ( H4
approval date ) or October 10 2002 ( date I travelled outside of usa).
This is not clear, either way it is more than a year.

Also, I have travelled on Advance parole in Nov 2004 and Dec 2006.

The RFE is asking for legal stay in USA. Not sure how serious this is ?

Will they deny my I485 ?

What happens if they deny my petition ?

Any thoughts ??????

My case also exactly same like yours except it happended on different year and month. ( Forgot to apply h4, St.Louis stamping, new H4 apprval, stamping in India, re-entry, applied 485).I am nervous regarding this and could you please help me on this.
My questions are,
1. Did you get any RFE regarding this on your I-485.
2.If So, could you please post the steps which you followed.

--if you got H4 visa based on spouse H1 then you came to US on H4 status and got I-94 at POE. where is your latest I-94?
