Did you use the AP recently? They give one year validity I-94 from the date of entry. My brother came yesterday with AP he got validity upto Nov-12-2007. well pardon me if I ma in wrong forum. I see all the experts are here so let me post my question
1.I had filed I-485 and I-140 concurrenty in 2004 on the basis of Physician working in medically underserved area my I-140 was approved and 485 is pending till I complete my 5 years.
I filed a perm in 2006 got approved filed a I-140 and concurret another 1-485 now I got my I-140 approved with RD of 08-06 ND of 09-06. I know I can interfile this I-140 with my 2004, 485 but I have questions whic my attorney does not have clear answer
My first question is regardin Ac21 portability since the hospital I am working for is not very stable financially
1 Do I need to withdarw the I-485 file in 08-06 before I request to interfile with 2004 I-485
2.Form which date they count 6 months receipt date or notice date
3 since they dont give a receipt AFTER interfiling what will happen if say I m laid off after six months, can I still be able to claim AC 21 after interfiling
