I recently got my H1-B Visa Stamping in Vancouver. My new I-94 will be expiring on September 15th 2001 (based on the validity of my passport). My H1-B Visa does not expire until 2004. My question is will I be out of status even though my H1-B Visa is still valid and my I-94 expired??
What\'s my next step?
Any infos will be much appreciated. Thanks!

No Title

Is it Sept 2002 or 2001? Generally I94 determines the stay-allowed -till date. In your case, you can get a new passport and perform a travel and get a new I94.
You can also apply for a new I94 by post . See the INS site.

Thank you jaxen.

Thank you for the information jaxen. I went to Vancouver, got my H1-B Visa stamping and upon re-entry to the US, was issued an I-94 with an expiry date based on the validity of my passport (September 15th 2002). I will go ahead and renew my passport so that upon re-entry to the US I will be get a new I-94 with a longer validity date.
Thanks again!

H1-Tranfer Denied

Hi All,
Here is some what complicated case.
I came to USA on H1 Visa on Company A , my Visa and I-94 was valid till Aug 2000 on Company A,
In between in March 2000 I changed to new Company B, who filled my H1 tranfer and I got WAC number in April 2000 itself. Based on WAC number I was working with Company B according to new law.

Here comes the complex part

In Oct 2000 I got H1 tranfer Denied Notice from INS specifying that I didn\'t submit some documents , which was not true. My attoreny filed for case to be re-opened for motion immediately before the expiry of appeal date.

But my Company B employer was very concerned , since my H1 tranfer was denied and my previous visa and i-94 too got expired...So Company B filed an new H1 visa in premium processing.. And now I got the approval for this New H1.....

My concern is Should I go to India to get this New H1 Visa Stamped or Should I wait for the decision of Case re-opening so that I can apply for revalidation in USA itself

I want to avoid to travel to India due to present condition and I feel there is a risk in getting Visa coz of my H1 tranfer denial case.

And INS and DOS are entirely differnet departments and they will look the case in different angles

Help on this is greatly appreciated
