I-94 missing for visa-revalidation

Hi All,

This is my friend's situation any feedback appreciated.

My friend moved to canada, at the border he submitted i-94.
After five months he got a job in US and came back on new H1B.

while coming back he had a valid visa with old company, INS didn't issue new i-94 for him at the border.

Now he wants to get a h4 visa in india for his wife.

What sould he say about old i-94??????

--- he faced Canada immigration and they dont ask for I-94

--- ---That was mistake of BCBP or BCIS Inspector; he needs to have valid I-94 to stay legally in US, you should talk to good lawyer immediately and fix that problem
Now he wants to get a h4 visa in India for his wife.

What should he say about old i-94??????
------ His wife may not be issued H4 they will ask for H1 visa holders valid I-94, at this time they are asking lot of documents from H1 holder, go to good immigration lawyer fix this problem ASAP
 
Do you mean he entered on past company H1b visa sticker in US? If he changed employer he may have new H1 approval notice with him, ask him to check the new H1 approval notice he may have I-94 attached, see the lower part right side of H1 approval notice if he has I-94 attached then he is OK

He has new i-94 with new h1b but still you need original i-94 for his wife h4 stamping i guess.

I will ask him to contact good lawyer.

---------- The I-94 that is attached to his H1 approval that is valid I-94; you should detach this from approval notice and attach it with your Passport. You should send the Copy of that h1 approval notice along with the I-94 copy (front and back) for H4 stamping
 
$6 is only to be paid if he again enters through Mexico or Canada border post, $6 is not to be paid if he enters through airport to US
