I-94 isuue.. got new H1 only..

I came to US on Company A. (Visa on Company A, and H1) Nov 2000. Its valid till Oct'2002 (both H1-b and Visa )
then I moved company B on Feb 2001. and working for Company B. I got H1 on Company B Its valid 2003 Nov, and I have I-94 also showed on my H1 which is valid till Nov 2003
But I didnt get stamped on new H1
Mean time I visited India and come back on May '2002
On that time I have 1 Visa (company A) and two H1's Company A and B
I showed both H1's to POE.
POE issued I-94 based on Company A (expires on oct'2002)
after that I get stamped on my new H1 (Company B) on May 2003 at St.Louis. USA by post..
My old I-94 is valid till oct 2002 (which POE issued)
on my New H1-B valid till Nov'2003


Now I applied new H1 on Sep 3 2003 with Premium processing with compnay C.along with for I-102 (adjustment status I-94)

They issued New H1 B approval Notice on sep 11.
But They didnt give me I-94 and saying that "an extension of stay be denied under CFR part 214.1.(c)(4). and allien is not the subject of deportion procedings under CFR part 242....


and asked to goto chennai consulate for visa stamping. If they issu Visa then will be fine or ... god knows

Now I am under situation if go to Chennai for visa. I dont know wether they issue visa or not...

..
If you anybody come across this issue .. plz help me out

Didn't you get a chance to get stamping done in May 02 when you visited India? At that time Chennai consulate is fine and one can get visa thru dropbox.

These days Chennai consulate taking more time to issue visas. Also one has to take a prior personal appointment, I believe. You can please check the chennai gov website for more info.

Thank you for your reply. I am looking in that too. But I am planning to request INS to change my consulate chennai to Mexico. So that I can go there get stamped soon. But I am not sure they issue visa for my new H1
Eventhogh If they issue.. May be problem with POE..
 
I am not sure whether BCIS may agree to obtain visa from Mexico becuase of the tightened security reasons. They may ask to get the visa from your home country. Anyway check with BCIS.

No problem. If all the documents are with you P.O.E won't be a problem except that the office may ask the reason why you had to goto Mexcio etc for which you have a convincing answer.

Caz I already Crossed 11 months out of status from their records..
 
in addition you have to get a letter from your attorney that you are still in employment (continuing employment letter) and if possible a letter from your client Manager that your services are very much required for the company etc.
