We are permenant residents of canada and do not have a H1B stamped in our passports, all we need to show at the border is our I-797 papers. But last year once we flew directly into US ( not from Canada ) and we were told that the PR is usefull only when we come through Canada and were issued a I-94 and asked to pay the visa waiver fees.
The officer at the counter entered H4 instead of H1 with the correct (H1)date for my wife, we did not notice this until after an year. Then we returned the I-94 to the Candian border and explained the mistake, the officer there said thats not a problem. And he said that the i-94 in the 797 paper is what matters for a PR.
Now we are planning to file I-485 and the lawyer says this might be a big issue, and she wants to gets this corrected before filing the 485.
Any insights into this. The whole issue of PR with no stamping and no I-94, makes things still worse.
