I-94 issued with wrong status but correct date in I-797

We are permenant residents of canada and do not have a H1B stamped in our passports, all we need to show at the border is our I-797 papers. But last year once we flew directly into US ( not from Canada ) and we were told that the PR is usefull only when we come through Canada and were issued a I-94 and asked to pay the visa waiver fees.
  The officer at the counter entered H4 instead of H1 with the correct (H1)date for my wife, we did not notice this until after an year. Then we returned the I-94 to the Candian border and explained the mistake, the officer there said thats not a problem. And he said that the i-94 in the 797 paper is what matters for a PR.
  Now we are planning to file I-485 and the lawyer says this might be a big issue, and she wants to gets this corrected before filing the 485.
  Any insights into this. The whole issue of PR with no stamping and no I-94, makes things still worse.

Getting I94 corrected is no big deal...

Do it. You should have insisted that they correct the I94 inspite of the INS officer said not necessary, when you noticed the H1/h4 error .

I guess the lawyer\'s argument is that a wrong I94 needs to be fixed no matter whether you should have got the I94 in the first place or not.

If you have H1 then you need I94 every time you enter US. You are going to adjust your status from H1 to PR (US). So you need a clean record of exit out of US and entry into US before applying for I485.

You can always wipe the slate off clean by going out and coming back in with a fresh I94.

I am also looking forward to correct that, but I am not sure if they will do that as I haven\'t noticed it for an year. Also the officer has taken the I-94 from me during the last entry when I tried to explain. So I am not sure how are they going to fix this as it is already into their system.

MISTAKE IN I-94 (MOST URGENT PLEASE REPLY)

My parents came last month. They don\'t know english, so they took help of somebody to fill the I-94 form. In my mother\'s I-94, he did a mistake and put her Middle Name instead of her First Name. I noticed this very recently. Now I want to correct it. How can I do it?

I tried to do it at airport but there they didn\'t allow me to go in and meet immigration officer. They gave me address to go to there Defered Inspection department. I went there also but there, no body is ready to listen.

Does anybody faced such kind of situation?

I am too much worried.

will there be any problem for her while going back?

Should I contact any lawyer? Do you know any good lawyer in New York City area?
