Hello,

We need to complete an I-94, a replacement for the arrival stamp in the passport. I tried to go to the INS website, but it's not available for download. Anyone know how to proceed?

The main I-94 is at the port of entry is the one that you fill out when you came to the US you won't find it at the USCIS it says "port of entry". If you need a replacement or correction on your I-94 then you need to file I-102, read the instructions.

If that is not the case then specify what is the circumstances and for what so we can help.

From Custom and border protection you can read this:
http://www.cbp.gov/xp/cgov/travel/id_visa/vwp/arrival_departure_record.xml

If the form that you are needing is the I-102 then:

Good luck,

I-94

Hi,

This would be the first step in obtaining a green card, then? When we met with an attorney, he specified that a passport stamp/I-94 was needed. Since we didn't have that, we needed a 102 form before we could even file the rest of our paperwork.

Well it suppose that you should have a I-94 if you enter the country legally. The I-94 is a little carton color white that the officer at the port of entry stamp or put a date on it...did you have it? When and how you enter the country? Your case is family based or what?

Please give more information...

Thanks

You should have your I-94 attached to your passport if you entered US legally. If it got lost or destroyed, or if you filing for extend of stay, or change of status, you can order a replacement by filing I-102:
http://uscis.gov/graphics/formsfee/forms/i-102.htm
But if you filing or planning to file for GC based on a family member, then why would you want to replace your I-94 when you already have one? Expired one will work just fine for the immigration purposes (but not if you planning to leave states and come back again in a future).
Of course… we are not aware of your special circumstances and all above is just a speculation.

I-94

My husband did enter legally, however, the I-94 was lost. So, we were told we had to apply for a replacement, which I guess would be the I-102 form. Our petition will be family-based, yes. Just want to be sure, since there are so many forms, that we only fill out what we need.

Has anyone a ballpark estimate on time and money for obtaining a green card?

You can check out all this forum about it and give you and idea that the best tools in your side is to have patience.
You are a USC or a GC holder? There is a difference if you are a USC or a GC holder, because the procedure of how and when to file are using the same forms but there is a waiting period if you are a GC holder.

All these should be explain by your attorney, if not I think he/she is not a good attorney. All questions and doubts should be answer by your attorney that is why you pay $$ to him/her.

Anyway for your peace of mind, please check the www.uscis.gov site. You will need to file many other forms, but before hand you need that replacement because that is part of the supportive documents that you need to send. Remember you send copies you keep the originals.

Now, definetly if it's lost then you need to fill out the form I-102 and follow the instructions. Read carefully all the instructions.

Good luck,
