I came to States on my old H1-B visa on Feb 2001. The immigration officer gave me a I-94 with expiry July 2003 same wit h my old H1-B visa expiry date. Then i change company in Apr 2001 and my new company applied a new H1-B for me and i got the new H1-B (expiry in Apr 2004) in July 2001 but without a new I-94. INS gave me the old I-94 number with no extension; same expiry date July 2003.

I suspect it could be my passport expiry in Dec 2003. INS ruled that H1-B visa holder must have at least 6 months validity on their passport during the term of the H1-B visa.

I can renew my passport in my country embassy here. So my question here is can i get a new I-94 up to the expiry of my current H1-B visa; that's is Apr 2004 without leaving the States?

Gurus out there, any comment would be welcome.

The simplest way is to drive to one of the border POEs and get the new I94.
You can also file I102 (Or something similar, check INS website , forms link, form to fix I94 error) at the local INS office after getting the new passport.

jaxen: thanks for your recommendation.

i have downloaded the INS Form I102 and i'm in doubt on the form Part 2 : Application Type. Below are the check box option given:-

(a) I am applying to replace my lost of stolen Form I-94.

(b) I am applying to replace my lost of stolen Form I-95.

(c) I am applying to replace Form I-94 it because it is mutilated. I
have attached my original.

(d) I am applying to replace Form I-95 it because it is mutilated. I
have attached my original.

(e) I was not issued a Form I-94 when i entered as a
nonimmigrant, and am filing this application for an extension of
stay/change of status.

(f) I was issued a Form I-94, Arrival-Departure Record; or Form I- 95, Crewman's Landing Permit; or Form I-20ID copy (for
nonimmigrant student) with incorrect information, and am
requesting INS to correct the document

None of the check box option seem to applied for my case to get my I-94 date extension. Or INS have any other form?

Another way is to get my company applied for an extension to my current H1-B visa but this option is ruled out as my company will only do that 3 months before my current H1-B visa expiry.

Jaxen, any comment on this?
