I came to States on my old H1-B visa on Feb 2001. The immigration officer gave me a I-94 with expiry July 2003 same wit h my old H1-B visa expiry date. Then i change company in Apr 2001 and my new company applied a new H1-B for me and i got the new H1-B (expiry in Apr 2004) in July 2001 but without a new I-94. INS gave me the old I-94 number with no extension; same expiry date July 2003.
I suspect it could be my passport expiry in Dec 2003. INS ruled that H1-B visa holder must have at least 6 months validity on their passport during the term of the H1-B visa.
I can renew my passport in my country embassy here. So my question here is can i get a new I-94 up to the expiry of my current H1-B visa; that's is Apr 2004 without leaving the States?
