I-94 expiring in few months!

Hi,

I'm on H1B, My I-94 will be expiring in Feb'2007 for the H1B which company 'A' filed for me. I've my visa stamped for the H1 filed from company 'A' whose expiry date is again '02/DD/2007'.
In June 2005 I transferred my H1 to company 'B' and got approval and its expiry date is May 2008.
I'm planning to go to India next summer some time in June. My question is can I go to India after my visa and I-94 stamped expired, though I have a new approved H1. Whats the procedure, can anyone pls let me know.

----------------- you have H1 Visa stamp through A till Feb,2007 you changed employer and youe new H1 approval notice is valid till May,2008 and you should be having I-94 till May 2008. if you go to India BEFORE Feb,2007 and you have valid visa stamp through A then you can come back to US with that valid visa stamp BEFORE the Expiry date of Visa stamp AND at POE show the valid visa stamp and H1 approval notice of B and you will get I-94 till May,2008, if you go out after Feb,2007 and Visa stamp is expired you need to get new Visa stamp.

-------------- you can go out after Visa stamp expiry. what is the date of your I-94 expiry?? you should be having I-94 till May 2008 attached with your H1 approval notice of B(right lower part) Check the approval notice

Yes I've a new I-94 from the H1 approval which is valid upto May 2008.
So If I go to India in June 2007 "after the visa expiry" from company 'A', can I come back and show the new I-94 at POE and get in or do I need to get visa stamped? Please clear my confusion on this. Appreciate it.

You must have VALID VISA STAMP for entry. If date on visa stamp is expired, you need new visa stamp. Also, if H1 was revoked by previous employer, your visa stamp may have been cancelled without prejudice.

You have to give up all your I-94 BEFORE you go out keep the copy of all I-94 (front and back) at home in your immigration file. You need to get NEW Visa stamp. You can also get visa stamped from Canada/Mexico before you go
