I-94 Expired

Hi,
My Passport and I-94 expired yesterday. My H1 Visa is valid till Jun 2003. I applied for my passport renewal 30 th december. I still did not get the passport. I am expecting it tomorrow. Do i have to go out of country to get the valid I-94 or can i go to local INS office ?.

Recommend against going to the local office since you are currently out-of-status (even though its technical) - and the local INS office could very easily start deportation proceedings. Recommend you/your lawyer file a premium processing case with INS service center to extend your H-1 retroactively from the date it expired.

usually its ok to go to the local office if the I-94 has not yet expired and you need to get it extended - but you're taking unnecessary risks if your I-94 has expired (no matter who's fault it is.)
