I 94 Expired with a valid H1

Hi,

Please provide some information regarding my situation with I-94 and H1 visa. My H1 Visa which was issued in 2007 has a validity till May 2nd 2009. My I-94 was also stamped with the same date when i entered US in 2007. Later i switched jobs and got a new H1 and I-94 which is valid till Sep 2010. But when i traveled abroad last year i had to submit both my original I-94 (validity of May 2nd 2009) and the new I 94 that i got along with my I-797A. At the POE,officer gave me a new I-94 again with a validity till May 2nd 2009. I just learned that I-94 controls the validity of my stay in US, and although i have a valid H1 i am still out of status as my I94 expired in May 2009. Could you please let me know what i can do to rectify the situation ? What are the chances of a CBP Officer issuing me a new I94 in accordance with my new I 797 A if i go to my previous POE? Or would i be barred from entering US again?

----------------------It seems that when you entered US you only gave your passport at POE and from the validity of Visa stamp officer gave you the I-94 valid till Visa stamp. If you have shown the passport with valid visa stamp AND latest H1 approval notice that is valid till Sep 2010 at POE then officer was supposed to give you I-94 till 2010.
. I just learned that I-94 controls the validity of my stay in US, and although i have a valid H1 i am still out of status as my I94 expired in May 2009.

Could you please let me know what i can do to rectify the situation ?

-------------Go to POE and every POE has deferred inspection. Request the officer to extend the I-94 as it was mistake of officer. Link for CBP deferred inspection

Or would i be barred from entering US again?
