Please could somebody help me with the following situation:

... I'm on H1B and I have an approved H1b revalidation for another 3 years. My I-94 is expired( the visa stamp in my passport is expired) ....and I want to leave U.S.....can I leave U.S with an expired I-94, then get my visa stamp in my home country..then return to U.S without problems?

....Do you get visa stamp in your home country even though you have an expired I-94?

.....What is the time limit for visa stamp since it expired?( which is the period that is allowed to pass between old, expired visa stamp and the new visa stamp?)....I heard something about 6 months or 1 year?

I would highly appreciate your input on this matter.
Thank you in advance.

Thanks ginnu......I have I-94 attached to the Aproval Notice......but before returning to U.S....I should go to the Embassy in my home country to get my visa stamp, shouldn't I?

Is it ok to stay legally in U.S with an expired I-94 and expired visa stamp on passport? What is the grace period till the new visa stamp?

What is the time limit till the new visa stamp....how much time you can stay in U.S legally till you get a new visa stamp?

Thank you so much again!

---to stay or work in US your valid I-94 is enough, Visa stamp is needed to ENTER US.
Thank you so much again!

When you have Valid I-94 attached with your I-94 H1 approval notice why you are posting your I-94 is expired? You have the latest I-94 with H1 approval take out and attach that I-94 in your passport.
When go out US the surrender ALL your I-94 stapled at airline counter (keep the copy of each I-94 front and back for your future records)
To enter US you will need H1 visa stamp from US consulate

Sorry...I misspelled the word : I-94 is expired...I wanted to say....it will expire in 1 month:

Here is my exact situation:

I have approved extension for H1B another 3 years, but my visa stamp expires in 1 month( the old one)...
......can I leave USA after my visa stamp expires and get another stamp at a consulate outside USA?

Thank you again!

----------- I think again you are posting wrong info, if you have H1 approved extension for 3 years then that H1 approval HAS I-94 that is valid till 3 years or till the validity of H1 approval notice. is that correct?

Thank you ginnu.....

My H1b approval notice is valid till 2010. But I was only worried about the visa stamp on my passport and on my I-94( the officer is putting a stamp with the date you entered U.S and also the expiration date of my H1b approval notice) when I will enter U.S again.

Thank you again....hoping now I make myself clear.:)

Please need some advice! i have always had a perfect record with imigartions and never a problem but have some doubts on my actual situation, please help...
I entered US on Sept 2010 and stayed for 6 months beacuse i wanted to find a college or university to study and wanted to travel, i had the money and have work license for 1 year, but every college that found was too expensive and wanted to try another options so applied for an extension to my 6 month, finally i had my license of 1 year so no problem, so submitted all the documentation the attorney recommended with more that 30 days before mi I-94 expired, waited for a couple of weeks and received a letter from immigations saying that my case was in evaluation and had to wait for the final desicion, the thing is that immigrations took too long making the final desicion and mi I-94 expired while i was waiting for the veredict. Finally my extension for 6 months was denied and in less than 1 week i retured to mi hometown, know its been nearly 3 months and i wanto to go back to US only for 1 week vacation to visit a friend, what would be the best thing to do???? i have shown my intention to leave us inmeditely and shown that have no intentions on staying, finally all my life is here.... please help
Additionally i have all the documents (my appication docs and all immigations letters) in originals and copy if the immigations official wants to confirm everythig, what should i do? i want to try goint to us as soon as possible, only for one week, please let me know what you think, thanks
