I-94 expiration and Advance payroll

I-94 expiration and Advance parole

Jim :

1) I was on H1 and was valid till 10/2003. I applied for Advance payroll in Feb 03.

2) In march, i went to india and came back to US in april (with H1) and got i-94 valid till 10/2003.

3) In 06/2003, Advance payroll is approved and is valid till 6/2004.


Now, my question is: Right now my i-94 is valid only till 10/2003. Do i have to get new i-94 after 10/2003?

Do i have to apply for extension of i-94?

Is Advance payroll (is valid till 6/2004) will do without new i-94 (I mean after 10/2003)?


Please tell me what i am suppose to do.

First thing is that it is "Advance Parole" and not "Advance Payroll". Stop thinking about payroll all the time.:D .

If you can get your H-1 extended then best thing would be get the H-1 extension then automatically you will have new I-94. Remember if you are married, get her extension also otherwise there are some complications later on.

If you don't want to extend your H-1 for some reason then you have the option of using EAD for continuing work and advance parole to enter the country.

It's best to have H-1 extended if possible because god forbids if something happens wrong with your application then you won't have a valid status to stay in the country.

Note: I am not an attorney, I have learnt this stuff from this forum and internet sites.
