I-94 Expiratioin and Adjustment of Status

Yes, as april19 has correctly pointed out, the I94 issued in March overrides the I94 you got with H1 transfer (which has a previous date - Jan 27). So your I94 has expiredon Mar 2004 and you were out of status till you got the next H1 on Sep 2000.

Guys we know that non immigrant visa validity depends on the I94. Shiva, get a good lawyer who could defend you well. Good luck.

So in the same vein, I currently have both an H1 Visa and a valid EAD... If I leave the country and enter on the Visa, will that invalidate the EAD?

Then explain this.

If some one comes here on a F1 Visa. Then gets H1 visa and starts working. He doesn't leave the country for 3 years then travels using AP, does that mean that during the period that person is on H1, they are out of status becuase they didn't use i94 to travel?
 
Person A comes into US using F1 in Oct 2000. Then he goes to his motherland in Dec 2001 and comes back in Jan 2002. He has an I 94 dated Jan '02. Now he applies for H1 and he gets a new I 94 say around Mar 02. This is the current I 94 so there is no problem in status at all.

In Shiva's case, when he entered US in Mar '99, he got a new I 94. The I94 issued with his H1 was in Jan '99. Now which one is the most recent, the one he got in the airport. So that is the one to be considered. That's why they say he was out of status from the expiry of that I 94 till the issue of the new H1.

This is what I have understood from the entire situation. I am not an immigration attorney to say I am 100% correct.
