I-94 Correction

I am working in US on H-1 B visa and my I-797 is valid till 10/2010 but my visa is valid until 10/2009. When I came back from India last year to newark airport, the officer at p.o.e stamped my d.o.s. till 10/2009. I pointed out to him that my I-797 was valid till 10/2010, he argued that d.o.s. expires with the visa. I came back and later found out that I could get my I-94 corrected. So, I went back to Newark airport (I stay in D.C.), the officer there refused to correct my I-94 and told me that the d.o.s. on the I-94 on my I-797 was till 10/2010 and as such I did not have to worry about the I-94 that was issued when I came back from India. That officer was so rude, she did not give me any chance to talk and directed me to the door. I know for a fact that only the latest issued I-94 is valid and my d.o.s expires on 09/30/2010. What options do I have? Can I go to Canada, get my stamping done and come back? Is there any risk involved?
