I-94 correction??

Hi! here's the situation: My spouse's Indian PP is expiring 10/2006. She has an H-1 stamped from her previous job which is good till 3/2006. She is going to India with her new I-797 approval (valid till 8/2008). On reading posts on this forum, it seems that there is a chance when she comes back, the immigration officer might stamp 10/2006 on her I-94 instead of 8/2008. I think that this is on his discretion. If that happens, does she have to go out of the country before 10/26 with a new PP and get it stamped. Or is this something that can be corrected here in the US itself. There is not enough time to get a new PP here before her trip or even in India when she is visiting.

Anybody with experience, please let me know. Thanks!

i do not know the answer to your question about the I-94 date, but do know that most Indian cosulates in the US have same day service for passport renewals. In India too, you can get same day service with a fee. I'd rather pay more money to the Indian consulates and get a new passport.

I94 - Validity until PP Expiry...

This is similar to my situation, which has happened recently.

My PP expires - Aug 2006
Visa Stamped Until - Feb 2007
I-94 - Aug 2006 (Issued on entering US)

I re-entered US last month with the PP (Due to expire in Aug 2006) and was given an I-94 until Aug 2006 (With a comment on the back of I-94 - Stating I94 issued until PP expiry date). Now I will have to renew my PP here @ Indian Embassy in US and I have no clue as to how to get my I-94 revalidated(extension)

According to my friends.
Get New PP (Renewed) - Indian Embassy
1. Either go to Canada (Again I will have to take a flight, it seems if u go by car(land), ur I-94 will not be revalidated)
or
2 . Go to local INS office and fill up a form ( I xxx) to extend I-94

Anyway Iam struck here...

Well, that is exactly what my wife's lawyer mentioned. That once we get the new PP, we can go outside the country and get it stamped. I am not aware of any option as to filling out a form with USCIS and getting it done here in the country. That will be great! Some people have mentioned getting this corrected at CBP Deferred Inspections office but when I called then today, they said that only if the POE made a mistake. Since, the POE is within his rights to put the PP expiry date, this is not considered a mistake.

As far as getting a new PP, we are trying to find out whether SF consulate will issue a new one on same day? No luck with their contact phones- expected from an Indian govt entity. They have a same-day service for emergency issue of PP and we want to know whether we wiil qualify under that. SF is 3-4 hours dwive from where we are but its worth a shot. My wife is getting a letter from her lawyer stating the necessity of getting a new PP. I dont think we will apply for a PP in India- have heard too many horror stories about that. They have something called "Tatkaal" service but I dont have much confidence in that.
