Hello everyone:
I have a question on I-94 card. Appreciate your response.
I came to U.S. in Sept 1999 on F-2 visa (dependent).
In Dec 1999, company "A" sponsored for H-1 and got approved in March 2000.
In Sept 2001, wanted to travel to India. So went to Mexico (Tijuana) for U.S. visa to enable me to re-enter U.S..
However also got Mexican visa at Mexican consulate for 7 days.
Went to Mexico, got U.S. visa stamped (my kid also accompanied me) and came back to U.S.
Though I didnot travel due to unavoidable circumstances and my One year Visa expired. That's perfectly not a concern.
However the concern is that I noticed on my passport that a fresh I-94 card was not issued at the mexican border.
The authorities at the border just stapled my H-1 approval notice from INS to my passport. They also stamped the date of entry on my passport (just a red stamp) stating my date of entry.
Nothing was stamped/written on the H-1 approval notice.
I was just going through my passport yesterday since the passport expires Sept 2003, I noticed this. It has been like more than a year now. I also noticed on the back of the H-1 approval letter that the lower portion of H-1 notice (below the perforation)is the replacement of I-94 and should be stapled together with original I-94 card for validity.
Can someone suggest whether it can pose a threat as far as maintaining status is concerned.?
I remember the while filing for EAD, the port and date of entry mentioned by me were the dates when I entered U.S. after mexican trip, however the dates do not match with the current I-94 card stapled to my passport when I came to U.S on F-2 visa.
Do I need to take some action now to avoid the hassles later since I am RD-Jan 2002 and ND-Feb 2002. for I-485.
