I-94 and advance payrole

Here is the story.

1. Holding H1B visa and applied 485, 140, AP and EAD in Jan 2003.
2. Went to india in March 2003 and came back to US in April 2003 with H1B (I-94 is valid till November 2003).

3. EAD and AP are approved in June 2003.
4. Received AP in July 2003.
5. EAD is not received due to Change of address.


Now, the question is:

Q1) Is this pesron has to leave the country after i-94 expires?

Q2) How can he get my EAD? Can he go to local INS office and ask them

to give a EAD? But EAD is approved in VSC. Right now he lives in NSC

area. He informed to INS about my change of adress (BCIS & VSC). So,

canHe go to Nebraska area local INS office to get EAD?

Q3) Can he go to Local INS office to get a new i-94?


What is he suppose do?
We need your Suggestion or advice in this matter.

---- NO, he will be in AOS pending status after I-94 expires
Q2) how can he get my EAD? Can he go to local INS office and ask them
---- you wrote that EAD has been approved, you may receive EAD card from VSC in few days or send letter to VSC with the EAC# of EAD filing that still you have not received EAD on your address (they may have not updated the new address)
to give a EAD? But EAD is approved in VSC. Right now he lives in NSC

---- He should also call up NCSC and talk to them inform about the problem provide you’re A# dob, name new address

---- He has already I-94 valid till November 2003, what is reason for asking new I-94?
What is he suppose do?

-- You have valid I-94 till November 2003, work on H1, if you want to be on H1 status while AOS is pending file for extension of H1 now as it takes time or you can use EAD after your current H1 expires
