So I have gotten no answers at all from anyone. My husband filed his I-90 form/renewal of his green card and they received it June 14 2006. He did his biometrics in July of 06 and its still says his case is received and pending. We called INS, went down to the local offices and no one gives us answers. I even wrote the Congressman and the same thing, just that its pending. His work is now really pushing for his renewal. The thing is he does have a felony from 1992 but he renewed his green card in 1996 so he was approved after this happened! He has done well since than. What should we do, what is the next step? Should we try to go for the permanent residency through marriage? We need this fast!

Now, If your husband has committed an aggravated felony USCIS will not renew his green card. reason being all thanx to the patriot act passed after 9-11. Any STATE aggravated felony will be upgraded to a Federal Felony which is subject to deportation. Your husband by have done time or not and may have completed his probation and not committed any crime there after but any legal or illegal alien who has been convicted with a deport able offense whether prior or after the patriot act was passed he or she is subject to be deported
Sorry no he does not qualify to be a citizen base on marriage he qualify to become a legal resident after being married to a US Citizen after 3 years he is eligible to be come a US citizens as long as he meets USCIS moral aptitudes and has not been convicted with any crime.

Wow you are angry! I am a wife of someone who made a mistake when he was 20 years old, now 36. This is haunting us and he did the time for his crime. We now have been together for 7 years, he has worked for his job 10 years and I am an Accountant. We have done well for ourselves. Do you believe in God and forgiveness because sometimes people make stupid mistakes and it was stupid, but he shouldn't be punished for the rest of his life. By the way he has lived here in the US since he was six months old so I don't consider him illegal, seeing that his parents are now citizens and his siblings were all born here! Say lay off and put that agression somewhere positive!

But thru your marriage he cannot qualify as he has been convicted with a crime

I will find out when they became citizens but I know it has been many years now. We are going to talk to a lawyer on Tuesday so hopefully we can get this resolved. I am sure it will be pricey but I guess I have no other options! thanks for the info!
