I need to fill out the affidavit of support and I'm still confused about i864A

If my father's the one providing income for me, do I write it on item 10 my curren individual annual income is......... or should I write in the part where I need to file out my asset i.e. balance in bank accounts and stocks etc.

and actually, I know my father will not give me money since i'm graduating, but for this purpose, can i have my father write a statement saying that he will continue to support my staying in the u.s?

I haven't got a job yet since I'm still at school (and it's my last quarter) and also since I don't have EAD to actually work.

And one more question- do I need to send all of my bank statement to show them I have this amount of money in my account? and if I write my father as my income, must I have my father write the letter statement that he's going to support me?

thank you for your help

dr_lha,

My husband, the U.S. citizen is the sponsor/petitioner. but his income doesn't meet the proverty level since he went study abroad for last year and wasn't able to work for 4 months.

and forgot to ask in my previous post.....

How STRICT is the USCIS on this form.... ??? Like they will probably still have need more if I provide letter from my father and my bank account?

The biggest concern I have is my tax. I worked in 2004-2005 and I filed the tax for year 2004, but didn't for 2005 (it's half a year work actually, and I don't even have my W-2 fo 2005), I don't know how big this problem will be, and how much details they need to know.

I only earned about $2000-3000 in 2005, is it considered low income thaat I i'm not required to file tax?

Do you live with your husband's father? If so he is a household member, his income can be included on your husband's I-864 form, and your father should fill out I-864A. If you don't live with your father-in-law, both he and your husband must fill out individual I-864 forms. Your father-in-law must meet the poverty level requirement by himself.

Sorry for my confusion. We don't live with my husband's father. I was referring to my father and he lives in Hong Kong, retired right now.

So basically our household size is 2. It just that I have heard of income from family member is also considered a type of income, but that was the case I heard of based on international students visa etc. I would assume in this GC case, it will still be considered a type of income but my husband said we just had to show my father will keep supporting me.

Sorry for my long questions, my husband who is native speaker even said the instructions is very vague, we want to avoid as many uncertainty as possible!

Thanks for your help again!!! :)

But I'm not writing my father as my joint sponsor.

Income from your family is still consider as a source of income right?

I'm not sure that you can use money given to you from your father in a foriegn country as income, no. My guess is that if you didn't file taxes on it (you didn't did you?), then you're out of luck.

I have a question on I-864, as a USC I need to submit 864 for my father's CP, but my income is not sufficient but my USC spouses should be, and we have always filed joint tax returns. Which one should I submite I-864 or I-864A by my spouse. Also do we just include the 1040 forms filled as evidence for i-864 ? thanks.
