I-864a Question

Hi everyone.

I filed a greencard for my wife. We filed on 1st week of march. INS cashed my check about week after, and 3 days later we received receipt for I-130, I-485, and others. But for some reason we did not get any receipt for I-864a and did not hear anything from INS regarding finger print date. Can you guys advise me what to do? We filed ourselves and I just hope that we did not make any mistakes.....

There is no receipt for Affidavit of Support (Form I-864)...never have... because this form is not an application/petition so to say it requires a fee; instead this form is a supporting documents for form I-485.

As for not receiving the notice for fingerprinting for so long then this is VERY usual situation; otherwise 98% of applicants do receive notice for biometrics within 2-4 days once they receive NOAs for their applications. Nevertheless, I've come across a few cases lately wherein people reported a similar situation like yours...meaning not receiving any notice for fingerprinting for so long despite of receiving NOAs. I don't know why this is happening but I assume it's because of submitting incomplete/wrong form I-864 which is based on my observation on few cases similar to your situation.

Your wife should call USCIS on their 800 number to find out what's going on because sometimes mails do get lost. So it could be possible that a notice for fingerprinting might have lost in the mail; otherwise not receiving a notice for fingerprinting given your timeline is very unsual situation. When she calls to USCIS, make sure don't tell anything to the operator who will come on the line. Just tell them that you didn't receive any receipt for the application since you filed the case and your check is not cashed yet too. This way they will transfer your call to immigration officer, otherwise not. And once you are transferred to immigration officer then you can give receipt number or A# to find out if USCIS has sent any notice for fingerprint in the past...or if not they why. Call USCIS at 1-800-375-5283 and press 1-2-3 to speak to the operator so that your call could be transferred to immigration officer. Do come back here to tell what they have to say about fingerprinting notice.

Okay. I just got off the phone with INS, and their answer was wait next 30 days then call us back. What I don't understand is that agent we spoke to also seem to very lost. We asked them exactly what's going on and status update. His answer was, it shows as still under review, and can not pull any other file or information regarding our status.

I guess we will have wait another 30 days, but this is really making our school and moving plan difficult.
