With reg to Affidavit of Support, Form I-864 : My husband who is a US citizen by naturalization was not working in 2012 and we were out of country for couple of years. Now he filed a green card for me second (first one got expired and I gave up in writing to obtain b2 visa to return to US).
He started working recently and submitted recent paycheck and Bank statements. We got an USCIS response requesting Initial evidence asking recent year (we believe 2012) TAX RETURNS (obviously my husband has no Income as were out of country so he didnt file tax returns BUT came to know recently he did get some settlement amount FROM his ex-employer which he thought NON TAXABLE INCOME) OR Explaination why not filed.
So, how do I respond ?
1. Should I say the truth that my husband was out of country for last couple of years (which he actually wrote on the i864 form - tax column) ?
2. File the return for the settlement amount
3. Find a Co-sponsor
4. Any other option ?
