I-864 Questions

Hi all,

I am a citizen, my wife and I recently married she is currently a H1-B visa holder, and we already living together for the past year. It is my understanding that I need to fill out the I-864 that needs to declare my income, but my concern is that I was in school at the time of last 3 years and had income below the poverty line. However, my wife is working and making 70k+ a year for the last 3 years.

My questions are:

1. Can she use her income to support herself?

2. If yes does she have to fill out the 864 to support herself? and do we have to fill out seperate 864s?

3. If we just need to fill out one 864 what questions do I have to be aware of?
such as Q8 and Q21.


Any help will be appreciated.

Tony, did you read and understand 864 - no? This is what is written on it:

"If your income alone is not sufficient to meet the requirement for your household size, the intending immigrant will be ineligible for an immigrant visa or adjustment of status, unless the requirement can be met using any combination of the following:

Income from any relatives or dependents living in your household or dependents listed on your most recent Federal tax return who signed a Form I-864A;"

Also read 864-EZ, she may be eligible.
