I-864 Question

I will be applying for my wife's GC next year. In the past 5 years my income has be over 30K. However, this year due to health situations, my income will be below the 125% of the poverty guidelines but do have a lucrative job. I really don't want to use a co-signer. Can a letter from my employer stating that my income will be higher than the guidelines?

Is your wife working too currently, you can include her income as well. You can also use your assets to qualify, they have to be a certain multiple of the income requirement.

I don't know if I can answer the question about the letter from the employer. To me, this is similar to a "job offer" which usually doesn't qualify. My understanding is that USCIS weighs your current income most heavily in making this determination. So if you apply next year, perhaps it won't be a problem? I'm assuming you'll already going to be resuming your 30k+ income then that you can show through pay stubs?

Maybe someone can comment on what the I-864 situation is for someone who's most recent tax return (in this case 2007) will show below the povery guidelines but 2008 income (the year when AOS will be applied for) can be shown through regular pay stubs to be expected to exceed poverty guidelines.
