can anyone tell me the answer to this question on the i-864 affidavit of support, the new form requires you only to send the last tax years returns off, it still however has a place to write the previous 2 years in, my question is on this year i am above the poverty level but for the last 2 years i have not been, are they only interested in the last years or all 3 years, if so i will need a joint sponsor.
thanks

Hi bobbyc666,
From what I understand, "for most i-485's filed before Nov. 23, 2005 the sponsor should have filed the three most recent tax returns". However, USCIS (as per change of policy in the final rules) is no longer required to request the earlier missing returns if the other evidence regarding current years return and current and anticipated employment is accurate and true. USCIS will first consider sufficiency based on anticipation of income in which i-864 is filed. When you file i-864 and i-485 is important to consider. However, they do state that any information filed that is untrue about current employment would be considered perjury. Anyone else?

From my experience, no - they're not interested in the previous tax years any more. Only the most recent one. I got RFE'd for this tax stuff, and they only wanted more papers for the most recent year, nothing from 2003 and 2004.
