I-864: Question Regarding Tax Return and Minimum Income

Hi,

I am petitioning for my parents, and now I am filing the I-864 form. I have two concerns regarding my current situation. First, I am a college student and my primary income source is the financial aid from school. I do not meet the minimum income requirement. Second, I haven't filed tax returns in the past two years (I filed one in 2003). What should I do?

I'm guessing you should find another individual, who does meet financial guidelines, and is willing to file an affidavit of support on their behalf. Or, if your parents have the financial means to contribuite to that affidavit...you can include their assets and any income. If they have sufficient means to meet the requirements, that could be a good outcome. Forget the student financial aid, doubt it will mean a thing. You can file back tax returns if necessary.

Otherwise, I think you would be wasting your time filing anything.

why didn't you file for your taxes? Taxes are important to the US govt, so failure to pay is viewed negatively and could derail many plans that you might have....

Unless you have a logical explanation for why you didn't file, this could be a deal-breaker... However, if possible use your parent's assets to offset your lack of enough income to secure a gc for them. Additionally, a secondary sponsor will be helpful..
