I-864 or I-864EZ?

I am sponsoring my mother only. i.e I petitioned I-130 with her only name.
Now, I received info to send Affidavit of Support from NVC.

I am confused on the instructions if I can file I-864EZ or I-864?

My single income is higher than the poverty line guideline chart. So, can I just send I-864EZ form?

Can someone please confirm for this. Just wanted to be double careful
before I sent 840EZ and then if I should have send 840 then the processing
delay etc.

The only confusion part for 840EZ i have is, for tax returns last 3 years I am filing married filing jointly. But I am planning to send my own *individual* income W2 forms along with joint IRS transcripts.

Does this still make me qualify to apply for I-840EZ?

Hi,

I think you can file either 840 or 840EZ. I sent 840 and it was fine. I too filed married jointly.

Thanks for the response. I sent 864EZ yesterday with IRS transcripts for Married Joint but individual W2 forms, employer verification letter and latest pay stubs. Let's see if they have any issues with it.

Which Consulate/Country is the GC application associated with?
 
I don't know why you're concerned that married filing jointly or separately should affect your eligibility to file I-864EZ. To be sure, here are the three requirements you need to meet:

1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;
2. The relative you are sponsoring is the only person listed on the Form I-130 petition;
3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

Looks to me like you meet all three of them. For example, if you were to use a combination of assets and current income, or if you were to include the income of the intending immigrant, or if you were someone's joint sponsor, or you sponsor multiple persons on the same petition, then you couldn't use I-864EZ.

My wife and I are joint income tax filers and she filed I-864EZ to sponsor me.

All that said, I do agree that the 3rd statement is confusing. How can your current income qualify based on a former employer ? And which W-2 are they referring to that the current salary is reported on, because your current salary would be reported on a future W-2.

Hi, my wife is trying to sponsor her Mom and we had the same question, she or I meet the requirements but all our taxes are filed jointly. I was wondering if filing the 864 EZ form worked for you? Thanks!
