Hi everyone,
I'm so glad I found this site after my several failed attempts of calling the NVC (the line was always busy!) I have several questions regarding form I-864. My situation is kind of complicated, I hope y
I already filed and sent I-864 two months ago. Since my income alone wasn't enough to support my daughter and her two sons, I got a sponsor to file another I-864. In my i-864, I also included my husband's "income" (He is the stepfather) along with his I-864A (He is on social security benefit and has been retired since 2004)
Last week I received a letter from the NVC stating that they need the following additional information on his I-864A:
1. Proof of current employment
2. W2 forms
I'm confused by this because in his I-864A line 9.c we already put that he is retired from his company since 2004.We had also included his SSB statements for most recent 3 tax years when we filed I-864/A to the NVC. Which leads to the next question, he hasn't been receiving W2 for years, why do they require that?
My family situation has changed quite drastically since we last submitted the I-864, so we will no longer use my husband's "income" to support my daughter and grandsons. Another question I have is, would it be possible for me to file the I-864 again WITHOUT including my husband's "income" (and hence, his I-864) since my income and the sponsor's are more than enough to support my daughter and grandsons. Would this affect anything since I have been filing joint tax-return with him for the past 3 years?
I will keep calling the NVC until I reach someone. But do you think they would be able to change what they require when I tell them I won't include my husband income in the form?
Thank you very much for your help!
