Wow that was a long thread.

I thought about this conversation all night and I think it is better to put my wife as "Unemployed". I will get the latest tax return form for my wife. It might be somewhere since, I remember I helped her file it.

I will also submit my tax returns and the employment letter from my employer. I think that will do it.

This means for my wife I will fill only one part of the three fields

Don't lose your sleep over it! I think you should put unemployed regardless, because she's not really "employed" by your business venture, it's more like she's an owner making a profit which is income, not strictly speaking paying herself. Or does she issue herself paychecks? :) Well, perhaps she could be considered self-employed, but then she'd be meeting certain tax requirements of self employed individuals such as paying herself FICA taxes etc.

I would think not including the business income as your wife's income is safer because it saves you from the uncertainty of what proof USCIS might be looking for. If you read the instructions for 23, it appears that the reporting of any specific income is really optional - current individual [...] annual income that you are using to meet the requirements - so not reporting the income I don't think will get you in trouble, and you can always claim her business income is too difficult to forecast to use it as proof.

My wife just called IRS and they are sending the tax returns for the past 2 years. So, everything is good!

Hi,

Just found my wife's 1040 tax return for year 2006. I think this would be enough since they only require one year tax return.

Also this 1040 form has many pages. I guess I will send all of them.

This includes the following:

1) Form 1040
2) Schedule C Form 1040 Profit or Loss from Business
3) Schedule SE form 1040 Self-Employment Tax
4) Form 8829 Expenses for business use of your income
5) Form 4562 DEpreciation and amortization

Another thing I noted about Form 1040 is that it is not signed by my wife. I mean her first name last name and other stuff is PRINTED on it but at the end it is not signed. I guess this is because the lady who helped my wife to filled the information send the form electronically.

Finally, all is good now :)
 
Make sure you send the forms that she received but was not required to file, such as 1099 for interest income etc. Since your wife files Schedule SE, I suppose she may be considered self-employed after all, but I don't know enough about this subject to give you a definitive answer.

You may want to confirm that an unsigned electronic filing copy is sufficient evidence for USCIS ... but you can always requesting IRS transcripts instead.
