I recently filed an I-130 petition for my mother. I submitted I-864 and I-864A, Affidavit of Support, to show that my husband and I meet the federal poverty guideline. I am a housewife with no income and the petitioner of my mother. However, my husband is a self-employed businessman who makes over six figures. As a petitioner, I have to file I-864, which I did. My husband signed I-864A because I could not meet the federal poverty guideline on my own. Few weeks later, USCIS office sent me a letter stating that they wanted me to fill out a new I-864 because I did not meet the minimum income requirement. Why did they do that? My husband's income should have supplemented my lack of income.
I am confused on what is going on with my situation. Would it be better for me and my husband to file I-864 individually as joint sponsors rather than my husband filing I-864A? Can anyone explain to me why a "joint sponsor" can file I-864 with the "primary sponsor" without filing I-864A? Why is there a need for I-864A? Or person filing I-864A is considered same as "joint sponsor"?
I do not know what to do now. Please explain how I can effectively file this document. Thank you.
