I’m an American citizen and my husband is Canadian. He acquired his K-3 visa as of July 16, 2003 and is ready to apply for I-485 (Greencard). As a sponsor, I’ll have to prepare the I-864 (Affidavit of Support).
Since I have two children, $22,062 is a minimum income requirement for 4- household size. The problem is that my 2001 income is $19,500 because I worked only from June to at the end of that year (7 months). Before that, I was a full time student; therefore, I don’t have any income in 1999 though my 1998’ income was about $33,000.
In 2002 last year, my income was $35,000 and my total income for as of today is already over $25,000 (I can prove it with my paycheck stub). I’m a registered nurse working at hospital and my income is over $40,000 although I work only part time and study full time.
In this situation, do I have to wait until I get my next complete annual income report to sponsor my husband, or you think that if I explain the situation, it would be accepted by the INS? Unfortunately, I don’t have any assets or can’t get any joint sponsor either. Please advise which would be the best case for my situation.
