I-864 Affidavit of Support Question

Hi,

I married a U.S. Citizen. I am currently on H1-B and working for the last three years. My wife (US Citizen) was a student last year and right now she does not have a job nor property to be my Sponsor. I am soon planning to applyi for green card. My question is I easily make way more than the US poverty line, So can I file I 864A and sponsor myself ?

I think the sponsor must be green card holder or US citizen.

Int he I-864 information sheet, it says "Income from intended immigrant if the income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is spouse his or her income can be counted regardless of current residence but it must continue from the same source until he or she becoms a lawful permanent resident"

I have a stable job for the past three years, so can i sponsor myself ?
 
you can. i did this. same situation as you.

as long as u live with ur wife, total household income which is what is used to compare should be over 125% poverty for that many members. to prove, you must be filing joint returns with ur wife.
 
You can't sponsor yourself per se. Your US citizen wife will be the sponsor, but there is a section of the I-864 where the immigrant's income can be added (if the source of income is legally authorized, which is the case for H1B). See question 24 part (b).

So technically my wife will be sponsoring and not using her own personal income but the family income ? In the form we can fill the family income in question 24(b), but what about question 22, which asks sponsor's income and employment ? Leave it blank ?

We got married this year (2013) so we haven't filed any taxes together.
 
She has no income, so write zero where it asks for the sponsor's income.

You don't need to file taxes together to be able to add your income.
