My USC wife is sponsoring me, and has only earned a qualifying salary in the most recent tax year (ie, 2004). Does this mean that, in addition to her federal returns and W-2s for 2004, for 2003 (which was a joint return with me) and for 2002 (filed before we were married), I have to file I-864A along with my relevant returns and W-2s for 2004, 2003 and 2002? OR, is only the most recent year of income used to qualify?

On the form it says that they consider only the recent year income but to be on safe side I would file I-864A to support the sponsorer if I have any income.

they do look at the last three years

but if the latest one is enough then it should be ok

as soon as they open up your package that is the first thing they check. If they don't like any little thing they will just send back the whole thing and let you know what you need.
