Hi,

I am planning to revalidate my H1b stamp from chennai consulate. I have I-797 copy of the full page. But I am missing the bottom portion of the I-797 paper .

Since i have important ceremony on beginning of next month , is that ok, if I get notarised the copy (which have full page of I-797 paper) ?


Please advice !
 
What do you mean by the bottem portion of I-797
So you did't get the I-94 along with I-797 or what ??

I got the bottom portion, I94 with i797 . but I have given the entire bottom portion to the airport people, while i went last time to india. now i got I94 stappled with PP, which got expired , according to my previous company stamp valid period. I made mistake by not showing my new petition which is valid upto next year,while i entered this country .

Please advice !

If your I-94 has expired, you are out of status. If so you may have problems.

It looks odd .. You made a mistake .. Technically you are out of status .. the only way is get a stamp from india .. i dont know how you are going to get .. But better talk to your Attorney..

But could anybody tell me whether is there any problem, if i go for stamping in india with only top portion of I-797 ?

I repeat what I said before, if you are out of status you may run into problems at the consulate AND at the port of entry. When did your I-94 expire?
 
I have new I-797 paper which is valid until next year. With it I am planning to stamp from india...If i got it stamped there wont be any problem at POE ,right ?

------ If I-94 expired April 2003 then you are out of status and staying/working illegally in US.

---- Do you mean that you have H1 extension or H1 transfer paper with valid I-94 attached until next year? If you don’t have I-94 attached you are out of status, go out and get the H1 visa stamp in passport. If I am not mistaken you have less salary on W-2 than LCA and now you are out of status. If your consulate is Chennai India be ready to listen the music they may also verify your all degree certificates and exp letters that you submitted at the time of first H1b visa approval, Chennai has fraud detection unit.
With it I am planning to stamp from india...If i got it stamped there wont be any problem at POE ,right ?
--- No problem at POE if you get h1b visa stamp and don’t have any criminal record or other issues and have valid job with US employer
